Forcibly Displaced Teachers from Artsakh Will Continue Working Under Indefinite Contracts: New Government Decision Draft

Iravaban.net has examined the draft government decision posted for public discussion on the e-draft.am legal acts draft publication website, which will introduce amendments to the October 12, 2023 Decision N 1756-L "On Approving the Assistance Program for Teachers Forcibly Displaced from Nagorno-Karabakh in 2023."

Essence of the Amendment

The draft provides an opportunity for teachers forcibly displaced from Artsakh who are already working in general education institutions under the program framework to continue working after their assignment period expires.

Specifically, teachers can continue working at the same institution without a competitive process if there is mutual consent from both the institution's director and the teacher.

Necessity of the Amendment

Currently, contracts signed with teachers involved in the 2023 Assistance Program for Teachers Forcibly Displaced from Nagorno-Karabakh have expired or are expiring (from the moment of contract signing until the end of the 2nd academic year).

The existing regulation does not provide teachers with clear mechanisms to continue their activities. The proposed amendments envision two possibilities:

  • Teachers can continue working at the same institution without competition, with the consent of the institution's director and themselves
  • Teachers who have already been released due to the expiration of their assignment period can participate in competitions announced for vacant positions

In both cases, work will continue on the basis of an indefinite employment contract, without providing the additional payment established by the decision.

Expected Results

As a result of the amendment, specialists displaced from Artsakh will have the opportunity to continue their professional activities in general education institutions and fill existing vacancies on the basis of indefinite employment contracts.

The necessity of the measure stems from the "Armenia Transformation Strategy 2050" program, the "State Program for the Development of Education in the Republic of Armenia until 2030," and the RA Government's 2021-2026 program.

Financial Impact

The adoption of the draft decision does not envisage an increase in state budget expenditures, as work will continue without additional payment.

The decision will enter into force on the day following its publication.
